International: Women and the ICC - Updates and Vacancies

Last week the ICC held consultations on the draft Regulations of the Registry. These regulations relate to the implementation of the Registry’s mandate and responsibilities as outlined in the Rome Statute.
The consultations last week related specifically to issues of court management, detention, participation of victims, legal representation, defence counsel, and support and protection of victims and witnesses.
The Women’s Initiatives, along with many other NGOs and professional associations, attended the consultations and stressed the importance of a gender-integrated approach by the Registry within each of their specific areas of responsibility, the need to promote the list of counsel, the rights of victims and the importance of being responsive to local conditions in providing support and protection.

Update - Women’s Initiatives for Gender Justice

We are currently conducting a review and gender analysis of all relevant reports on the conflict in Darfur including the United Nations Report of the International Commission of Inquiry on Darfur, which led to the Security Council referral to the ICC.

We are considering a number of UN documents as well as reports by international agencies and international human rights organisations. The immediate purpose of this review is to inform ourselves of the gendered nature of the violence occurring, to consider and critique the way gender based crimes are reported and characterised, and to develop an overview of the types of violations women are subjected to in this ongoing conflict and humanitarian disaster.

It is clear from our research to date that gender based crimes are widespread. Raids on villages are most often accompanied by rape and other forms of sexual violence, public rapes and gang rapes are commonly practiced. Women are regularly abducted during raids and around camps and sites for internally displaced people, and after capture women report having their arms and legs broken to prevent them escaping.

This review will assist our advocacy work on Darfur with the ICC . We are urging the Court to take a strong and committed approach to investigating gender based crimes in Darfur and pressing the ICC to explicitly include these crimes, and indicate their plans to address them, in their preliminary report to the Security Council at the end of June 2005.

ICC Vacancies

The ICC continues its recruitment process to staff the Court in preparation for its substantive work.

As part of our effort to promote the appointment of women to key positions, we are sending regular notifications of relevant vacancies at the ICC, as well as updates on the appointments made. Please continue to assist us in identifying suitable women candidates and encouraging strong applicants for these positions.

There has been an outstanding response to our outreach email on Friday (May 20) regarding the call for women to apply for the roster of Psychosocial experts. The ICC informed us that by Monday May 23 they had received 10 applications from women for the roster as a result of this outreach, many of whom they considered highly suitable as expert consultants.

Once again, thank you for your rapid response to this issue. A reminder that the application process for the roster is open, which means you can apply anytime, there isn’t a closing date. We will keep you posted with further information regarding the roster as we hear more from the Court.

Appointments

Review of Appointments to the ICC

We are now undertaking a review of staff appointments to the Court within the Judiciary, Office of the Prosecutor, and the Registry. We are examining the number of women appointed, the level of positions to which women are appointed, the participation of women in senior management, the participation of women in decision-making structures of the Court, and the participation of women in determining appointments to the ICC.

Vacancies

The Rome Statute requires that in the employment of staff, the Prosecutor and Registrar must have regard for the representation of the principal legal systems of the world, equitable geographical representation, and fair representation of women and men.

We are continuing to work with the Court to address their responsibility in ensuring gender balance and regional diversity amongst the staff of the ICC.

Please note, the Court is now indicating a preference for applicants from a State Party to the ICC Statute, or from a State that has signed and is engaged in the ratification process. However, the Court also states applicants from non-state parties may also be considered.
